The combination of a US LLC + Paraguayan fiscal residency is the most common structure among digital nomads looking to legally optimize their tax burden. But it has conditions, limits and risks you need to know before implementing it.
Why it works (in theory)
A single-member LLC is, for US tax purposes, a "pass-through" entity. If the owner is a non-US resident and non-US citizen, and activity is performed outside the US, the LLC may not generate federal tax obligation in the US.
In Paraguay, thanks to the territorial principle, foreign-source income is not subject to IRP. Therefore, dividends withdrawn from your US LLC pay no tax in Paraguay.
Risk factors
- Home country: If you are a citizen of a country that taxes global income, that country may still claim your income if you maintain strong ties
- CRS/FATCA: Your LLC's bank accounts may be automatically reported to your home country's tax authority
