Terms and Conditions

1. Acceptance of the terms

By accessing ViaParaguay.com and using any of its features, you accept these Terms and Conditions in full. If you disagree with any of them, the appropriate course is not to use the site.

To register, contract a service or buy tickets you must be over eighteen years of age and have legal capacity to enter into obligations. If you act on behalf of a company, you represent that you have sufficient authority to do so.

2. Definitions

To avoid ambiguity, the following expressions are used throughout these terms:

• Platform: the ViaParaguay.com site, its subdomains, its applications and its associated services.
• User: any person who accesses the Platform, whether registered or not.
• Advertiser or Publisher: the real estate agency, developer, business, professional, artist or organiser that publishes content or contracts visibility services.
• Organiser: the party producing an event whose tickets are sold through the Platform.
• Content: texts, photographs, floor plans, videos, prices, data and any other material published on the Platform, whether our own, uploaded by an Advertiser or syndicated from an external source.
• Annexes: the documents governing specific services, which form an integral part of these terms for those who use them.

3. Purpose of the service

The Platform gathers, organises and publishes information about Paraguay for those looking to live, invest, work or travel in the country. The services it offers, or may offer, are:

• Publication and search of properties for sale and for rent, and of real estate developments.
• A directory of real estate agencies, developers, businesses, professionals and service providers.
• Editorial content about cities, neighbourhoods, destinations, administrative procedures and current affairs.
• An events calendar, with ticket sales and issuance on behalf of the organisers.
• Vouchers, benefits and promotions from participating businesses, and their redemption.
• User tools: account, favourites, comparison tool, saved searches and alerts.
• Visibility and promotion services available to companies and professionals on a paid basis.
• An affiliate programme and access through an application programming interface for authorised integrations.

4. Availability of the services

Not all of the services listed are available at all times, in every city or for every account. Some require prior enablement, a contracted plan or approval of the registration.

The Platform may add new services, modify existing ones or discontinue them. Where discontinuation affects a service that has been contracted and paid for, the provisions of the Publishers Annex apply.

5. The platform's role

This is the most important section of the document, because the scope of everything else depends on it.

ViaParaguay publishes its own content and that of third parties. It is not a real estate agency and does not act as a real estate broker. It takes no part in negotiations, represents neither party, receives no commission on transactions and does not guarantee that any transaction will be completed.

The properties, products and services published belong to their respective owners. The Platform owns none of them, holds no portfolio of its own and does not market them on its own account. Each listing is published by a real estate agency, a developer, an independent professional or an authorised owner, who represents that they hold the mandate, authorisation or current right to offer it.

Any contract of sale, lease, provision of services or otherwise that you enter into on the basis of a listing is concluded exclusively between you and the Advertiser. The Platform is not a party, agent, surety or guarantor of that contract, and is not answerable for its performance.

In ticket sales, the Platform acts on behalf of the Organiser, who is responsible for the event under the terms of the corresponding Annex.

The Platform does not provide legal, tax, accounting, financial or investment advice.

6. User account

Some features require creating an account. The details you provide must be truthful and up to date; keeping them so is your responsibility.

Your password is personal and non-transferable. You are responsible for safeguarding it and for all activity carried out from your account. If you detect unauthorised use, tell us immediately through the contact form.

You may register or sign in with your Google or Facebook account. In that case we receive your name, email and profile picture from those services, as set out in the Privacy Policy.

You may close your account at any time. Closing it does not delete data we are required to keep under a legal obligation, nor listings you published on behalf of an Advertiser.

7. Third-party and syndicated content

Most of the listings you see on the Platform were not written by us: they are uploaded by Advertisers or syndicated automatically from external sources with which we have an agreement.

This means prices, floor areas, locations, features, photographs and availability may be out of date, incomplete or contain errors, and the same property may appear with different details depending on who lists it. We do not independently verify that information and we do not guarantee its accuracy.

Each listing reflects the details the Advertiser obtained when taking the property on from its owner. The accuracy of those details depends on that intake and on the diligence of whoever carried it out, so the agency, developer or independent professional that published the listing is answerable for them, not the Platform.

ViaParaguay confines itself to distributing that information and putting the interested party in contact with whoever published it. It does not measure properties, verify title deeds, carry out valuations, audit the conditions offered, or take part in whatever the parties subsequently agree.

In the Directory, where a piece of information has not been confirmed by the business itself or by the ViaParaguay team, it may come from public sources or from third-party services such as Google Places; opening hours are one example. The listing says so where applicable. Such data is provided for guidance only, may not reflect recent changes, and should be confirmed with the business before travelling.

Before making any decision, handing over money, signing a document or travelling to view a property, verify the details directly with the Advertiser and, where appropriate, with the relevant public registries. This verification is your responsibility and no feature of the Platform replaces it.

If you find a listing containing false or misleading information, write to us through the contact form and we will review it.

8. Reviews and user content

The Platform allows reviews and ratings of agencies, businesses and professionals to be published. In publishing them you undertake that they will:

• Reflect a real, first-hand experience with the party being reviewed.
• Contain no insults, threats, discriminatory expressions or unlawful content.
• Include no personal data of third parties, confidential information or material protected by someone else's copyright.
• Not be paid for by the party reviewed or by a competitor, nor seek to manipulate their reputation.

9. Licence over the content you publish

You retain ownership of everything you publish. By publishing it you grant us a non-exclusive, royalty-free, worldwide licence to host, display, technically adapt and translate it, for the sole purpose of providing the service.

We may moderate, edit the formatting of or remove content that breaches these terms, without this obliging us to review in advance everything that is published.

10. Content assisted by artificial intelligence

Part of the Platform's content is generated or assisted by automated systems: translations between the site's languages, summaries, descriptions of properties and areas, and illustrative images for articles and guides.

These systems may produce inaccuracies. Where a discrepancy exists between an automatically generated description and the official details of the property, development or Advertiser, the latter prevail.

The illustrative images accompanying articles, guides and area pages are atmospheric in nature: they do not depict a specific property and constitute no promise as to its condition or views.

11. Calculators and estimates

The mortgage calculator, price estimates, area indicators and any other calculator on the Platform are reference tools built on general assumptions.

They do not constitute financial advice, a valuation, a credit offer or a promise of approval by any institution. The actual terms of a loan or a transaction are set exclusively by the institution or party concerned.

12. Prohibited uses

In using the Platform you undertake not to engage in any of the following:

• Using the site for unlawful purposes or contrary to good faith.
• Extracting the catalogue, the directory or any dataset in bulk or by automated means without written authorisation, whether by crawling, scraping or similar techniques, as well as reconstructing an equivalent database or reselling the information obtained.
• Accessing or attempting to access systems, accounts or restricted areas without authorisation, conduct covered by Law No. 4,439/2011 on computer crime.
• Publishing false or misleading information, or advertising properties, products or services over which you hold no right or current mandate.
• Impersonating another person or company, or claiming an authority you do not hold.
• Infringing third parties' intellectual property, image, honour or privacy rights.
• Interfering with the security, integrity or availability of the service, or introducing malicious code.
• Using contact details obtained on the Platform to send unsolicited commercial communications.

13. The platform's intellectual property

The structure of the site, its design, its source code, its editorial texts and the selection and arrangement of the contents of its database are protected under Law No. 1,328/1998 on Copyright and Related Rights.

You are granted a limited, revocable, non-exclusive licence to access the site and use its contents for personal purposes. Any commercial use, reproduction or exploitation requires written authorisation.

The name ViaParaguay and its logo identify the portal. The conditions for referencing it from another site, outlet or partner material are set out in the brand guide.

14. Reporting infringing content

If you hold a right and consider that content published on the Platform infringes it, write to us through the contact form stating:

• The work, trade mark or right you consider infringed.
• The exact address of the page where the reported content appears.
• Evidence of your ownership or of your authority to act on the owner's behalf.
• Your contact details and a statement that you are acting in good faith.

15. Availability of the service

We aim to keep the Platform continuously available, but we do not guarantee it. The service may be interrupted by scheduled maintenance, infrastructure provider failures, cyberattacks or events of force majeure.

We may modify, suspend or discontinue features at any time. Where an interruption is scheduled and foreseeable, we will endeavour to give reasonable advance notice.

16. Links and third-party sites

The Platform contains links and redirects to the websites of Advertisers, external sources and other third parties. We do not control those sites, we do not review their content and we are not answerable for their privacy practices or for the products or services they offer.

Accessing an external site from the Platform is at your own risk and is governed by that site's terms.

17. Limitation of liability

Within the limits permitted by Paraguayan law, the Platform is not liable for:

• The accuracy, truthfulness, currency or lawfulness of content published by Advertisers or syndicated from external sources.
• The default, conduct or solvency of an Advertiser, an Organiser or any third party with whom you contract on the basis of the Platform.
• Indirect damage, loss of profit, loss of a business opportunity or reputational harm arising from use of the site.
• Interruptions, failures or data loss caused by infrastructure providers, cyberattacks or force majeure.
• Decisions you take on the basis of calculators, estimates or automatically generated content.

18. Preservation of consumer rights

No clause of these terms limits, excludes or diminishes the non-waivable rights that Law No. 1,334/1998 on Consumer and User Protection grants to those qualifying as consumers.

Nor is the Platform's liability excluded for wilful misconduct or gross negligence attributable to it.

If any clause is declared void or unenforceable, the remaining terms retain full effect.

19. Indemnity

If you publish content or use the Platform in breach of these terms or of the law, and this gives rise to a claim, lawsuit or penalty by a third party or an authority against the Platform, you undertake to hold it harmless and to bear the reasonable costs of defence arising from your conduct.

20. Suspension and termination

We may suspend or terminate an account, and remove content, where these terms are breached, where false information is published, where there is a substantiated report from a third party, or where a competent authority so requires.

Where circumstances permit, we will give prior notice and state the reason, so that the situation can be put right. In cases of risk to other users, to the security of the service, or of manifest illegality, the measure may be applied immediately.

21. Annexes

The following documents govern specific services and form an integral part of these terms for those who use them. In the event of a conflict between an annex and these general terms, the annex prevails in respect of the service it governs.

• Annex A — Terms for Publishers: applies to agencies, developers, businesses, professionals, artists and organisers that publish content or contract services.
• Annex B — Ticket purchase terms: applies to anyone buying tickets for an event through the Platform.
• Annex C — Affiliate Programme terms: applies to anyone taking part in the referral programme.
• Annex D — API and automated use terms: applies to anyone accessing the data by programmatic means.

22. Consumer information and right of withdrawal

Before you contract any paid service, the Platform makes clearly available the total price, the steps to complete the contract, the payment methods available and how to correct input errors, in accordance with Law No. 4,868/2013 on Electronic Commerce.

Article 26 of Law No. 1,334/1998 grants a seven-day right of withdrawal for contracts concluded away from business premises, as online contracts are. The specific conditions for exercising it are set out in Annex A for subscriptions and visibility services, and in Annex B for ticket purchases.

If you are a consumer, you may file complaints with the Consumer and User Protection Secretariat (SEDECO), without prejudice to writing to us first through the contact form so we can try to resolve the matter directly.

23. Changes to these terms

We may amend these terms to reflect changes in the services, in technology or in applicable law. The version in force is always the one published on this page, with its last updated date shown at the top.

Where a change is substantial we will communicate it through a prominent notice on the site or by email to users with an active account. Use of the Platform after the change takes effect constitutes acceptance of the new version.

24. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Paraguay.

For any dispute arising from their interpretation or performance, the parties submit to the ordinary courts of the city of Asunción, without prejudice to the venue that consumer protection legislation may afford a user qualifying as a consumer.
