Annex A — Terms for Publishers

This annex governs the relationship with those who publish content or contract services on ViaParaguay: real estate agencies, developers, businesses, independent professionals, artists and event organisers. It supplements the General Terms and Conditions; it does not replace them.

1. Who this applies to

This annex applies to any individual or legal entity that publishes content on the Platform, holds a directory listing or contracts a visibility service, hereinafter the Publisher.

It applies together with the General Terms and Conditions. In the event of a conflict between the two texts regarding the relationship with the Publisher, this annex prevails.

General Terms and Conditions

2. Registration and verification

Registration as a Publisher requires prior approval. We may request documentation evidencing the existence of the company, its tax identification, its licences and the authority of whoever manages the account.

We may refuse a registration, or revoke it later, where documentation is insufficient, where the information proves inaccurate, or where there are well-founded indications of irregular activity. The decision is communicated with its reason.

The verification carried out by the Platform is intended to reduce the risk of fraud. It does not constitute an endorsement, a certification or a guarantee as to the Publisher's solvency, professional competence or commercial conduct towards users.

3. Accounts with multiple users, branches and agents

A Publisher account may have several associated users and several branches, and may correspond to a company operating under a wider brand or commercial network.

The account holder is answerable for all content published from it, regardless of which user or branch uploaded it. It is their responsibility to grant access only to authorised individuals and to revoke it when they cease to be so.

Where the Publisher forms part of a network, franchise or group, the contractual relationship with the Platform is understood to be entered into with the individual or legal entity named as the account holder and contracting the service, without the Platform becoming bound to the other members of that network by reason of that membership alone.

If an agent ceases to belong to the Publisher, it falls to the Publisher to withdraw their access and decide what happens to the listings they managed. The Platform does not arbitrate internal disputes over ownership of a portfolio.

4. The Publisher's obligations

In publishing on the Platform, the Publisher undertakes to:

  • Publish only properties, products, services or events over which it holds a current mandate, authorisation or right, and be able to evidence this on request.
  • Ensure the accuracy of the price, currency, floor area, location, condition and features of what it publishes, and of the conditions of any promotion.
  • Update or withdraw the listing without delay when the property is sold, let, ceases to be available, or its conditions change.
  • Not publish the same property in duplicate, nor with altered details, in order to occupy more space in the listings.
  • Not publish bait pricing, conditions it is not prepared to honour, or information misleading as to the nature of the transaction.
  • Hold the licences, professional registrations and authorisations required for its activity under Paraguayan law.
  • Comply on its own account with the obligations incumbent upon it as a reporting entity before the Secretariat for the Prevention of Money or Asset Laundering, under Law No. 1,015/1997 as amended by Law No. 6,497/2019 and SEPRELAD Resolutions 201/2020 and 241/2020. The Platform neither assumes, supervises nor replaces those obligations, which belong exclusively to the Publisher.
  • Respond to the enquiries it receives within a reasonable time and with truthful information.

5. Automated upload and content syndication

The Publisher may agree with the Platform that its inventory be uploaded automatically, by means of an exchange file, an integration with its management system, or access to a source the Publisher itself maintains.

Content arriving by that route is subject to the same obligations as content uploaded by hand: accuracy, ownership and updating. Errors originating in the Publisher's source are its responsibility, including incorrect prices, duplicate listings and properties no longer available.

The Platform may reject, normalise or unpublish records that arrive incomplete, duplicated or inconsistent, and may suspend an integration that degrades the quality of the catalogue or the stability of the service, stating the reason.

The fact that a property is published automatically does not alter the Platform's role: it still does not independently verify the information and still is not a party to the transaction.

6. Content and licence of use

The Publisher represents that it owns the photographs, floor plans, renders, videos, logos and texts it uploads, or holds a licence sufficient to publish them and to grant the licence described below.

The Publisher grants ViaParaguay a non-exclusive, royalty-free, worldwide licence to host, reproduce, technically adapt, resize, translate into the site's languages, apply the Platform's identifying logo to, and distribute that content on the site, in its newsletters and on its social media profiles, for the purpose of promoting the listing.

The licence remains in force while the listing is active and, after its removal, for the reasonable period during which copies persist in caches, in search engines and in material already distributed, without this creating any obligation to withdraw them retroactively.

The Publisher retains ownership of its content and may request its removal at any time, subject to the scope described in the preceding paragraph.

7. Use of trade marks

The Publisher authorises the Platform to use its trade name and logo for the sole purpose of identifying its listings, its directory entry and the material distributing that content on the site, in newsletters and on ViaParaguay's social media.

The Publisher may use the ViaParaguay name and logo to indicate that it publishes on the Platform, subject to the conditions in the brand guide. They may not be used in a way that suggests an association, certification, exclusivity or partnership that does not exist.

Neither authorisation transfers ownership of any trade mark, and each party may revoke it when the relationship ends, subject to the same time allowance provided for material already distributed.

8. Moderation of listings

The Platform may edit a listing's formatting, correct its classification, normalise its geographic location, translate it and adapt its images to the site's formats, without altering the substantive details supplied by the Publisher.

We may unpublish, reject or request the correction of content that breaches these conditions, is misleading, is duplicated or has ceased to be current.

In the event of serious or repeated breaches we may suspend the Publisher's account. Where circumstances permit, we will give prior notice and state the reason, so the situation can be put right.

9. User enquiries

When a user sends an enquiry about a listing, the Platform passes the contact details and the message to the Publisher so that they can reply.

In respect of that data, the Publisher acts as an independent controller and is answerable for compliance with personal data protection law, in particular Law No. 7,593/2025 once in force.

The Publisher undertakes to use that data solely to answer the enquiry and manage the commercial relationship arising from it, not to transfer or resell it, not to add it to unsolicited marketing campaigns, and to honour the rights the data subject exercises against them.

The Platform keeps a copy of enquiries in order to provide support, monitor service quality, resolve disputes and settle commissions where applicable, in accordance with the periods set out in its Privacy Policy.

10. Plans and prices

The available plans, their listing limits, the features they include and their prices are published on the site and form part of this annex by reference.

Prices may change. A price change does not affect a period already paid for: it applies from the following renewal and is communicated with reasonable notice so the Publisher can decide whether to continue.

Unless expressly stated otherwise, prices are quoted inclusive of the taxes applicable under the tax legislation in force.

11. Payments

The enabled payment methods are stated during checkout and include bank transfer and the payment gateways available at the time.

The service is activated once payment has cleared. In the case of bank transfer, clearing may require manual verification of the receipt, which can delay activation by up to one business day.

Failure of a reported payment to clear, or the subsequent reversal of a cleared payment, entitles us to suspend the service in accordance with the section on suspension for non-payment.

12. Invoicing

The Platform issues the invoices required under Paraguayan tax legislation, using the tax details the Publisher has declared in its billing profile.

The Publisher is responsible for the accuracy of those details — legal or trading name, tax identification, address, city and billing email — and for reporting any change before the next invoice is issued.

Invoices are sent to the declared billing email and remain available in the Publisher's dashboard. The issuance of a corrective invoice due to incorrectly declared details is subject to the deadlines and requirements set by tax regulations.

13. Term, renewal and cancellation

Services are contracted for periods, the duration of which is stated at checkout. Unless notice is given to the contrary, the service renews for equal periods so that listing visibility is not interrupted.

The Publisher may cancel renewal at any time from its dashboard or through the contact form. Cancellation takes effect at the end of the current period, which is provided in full because it has been paid for.

When the subscription ends, listings cease to be featured and, depending on the plan, may cease to be published. The Publisher's details and history are kept in accordance with the Privacy Policy, so the service can be reactivated without having to upload everything again.

14. Right of withdrawal and refunds

Where the Publisher qualifies as a consumer under Law No. 1,334/1998, the right of withdrawal in article 26 applies: they may withdraw from the contract within seven calendar days of its conclusion, since it is a contract concluded away from business premises.

If the service has not been used — that is, if no content was published or featured during that period — the full amount paid is refunded.

If the service has already been partly provided, because listings were active or featured during the period, the amount paid is refunded less the proportionate part actually provided, calculated by days elapsed.

Outside the seven-day period no refund is due for the current term, unless the interruption of the service is attributable to the Platform, in which case the time not provided is compensated either by extending the period or by refunding the proportionate part, at the Publisher's choice.

15. Suspension for non-payment

If a period is not paid on the due date, the Platform will notify the situation and may suspend the visibility of the listings once a reasonable time has elapsed since that notice.

If non-payment persists, listings may be unpublished. The account and the uploaded content are retained for a prudent period to allow the situation to be regularised, in accordance with the periods set out in the Privacy Policy.

Suspension for non-payment does not extinguish the debt corresponding to the period actually provided.

16. The Publisher's liability

The Publisher is answerable to users and to third parties for the content it publishes, for the truthfulness of the information it disseminates, for honouring the conditions it offers and for the commercial relationship it enters into following an enquiry.

That responsibility extends to the details arising from its own intake of the property: the price, floor area, location, age, condition, registry status and the terms of the transaction. The Platform does not measure, verify or audit them, so an error in any of them is attributable to whoever entered it, not to the Platform's distribution of the listing.

If the published content or the Publisher's conduct gives rise to a claim, lawsuit or penalty by a third party or an authority against the Platform, the Publisher undertakes to hold it harmless and to bear the reasonable costs of defence arising.

17. No exclusivity

The relationship between the Publisher and the Platform is not exclusive in either direction.

The Publisher retains full freedom to list the same properties on other portals, on its own website and through any other channel, and to do business with whomever it chooses.

The Platform retains full freedom to publish content from other companies in the same sector, including those competing directly with the Publisher, and to determine the order and presentation of results according to its relevance criteria.

Nothing in this annex creates an employment, corporate, agency, franchise or representation relationship between the parties. The Publisher is not authorised to assume obligations on behalf of ViaParaguay, nor ViaParaguay on behalf of the Publisher.

18. Scope of the service and limitation

The Platform provides a publication and distribution service. It does not guarantee any particular volume of visits, enquiries, completed transactions or revenue arising from a listing.

The order in which listings appear reflects criteria of relevance, recency and match with the user's search, together with the contracted plan in the case of featured positions. The Platform may adjust those criteria to improve the search experience.

The view and enquiry metrics shown in the dashboard are estimates and may differ from those of other measurement tools.

19. Term and changes

This annex may be amended to reflect changes in the services or in applicable law. The version in force is always the one published on this page, with its last updated date shown at the top.

Where a change substantially affects the Publisher's financial terms or obligations, it will be communicated by email with reasonable notice. If the Publisher does not accept the new version, they may cancel renewal without penalty.
